Late Breaking News The National Conference of Commissioners on Uniform State Laws and the American Law Institute agreed in early April to change the status of NCCUSL's software licensing provisions from a Uniform Commercial Code revision to uniform legislation.
The proposed law's new designation, as the Uniform Computer Information Transactions Act, reflects ALI's problems with the legislative proposal and its decision to postpone voting on it until next year. Although there were no organizational requirements that NCCUSL change the status of the legislation from a UCC revision to uniform legislation, NCCUSL agreed to do so to avoid delays in bringing the proposal before state legislatures and to avoid friction with partner ALI . While the legislation will no longer carry the strong imprimatur of UCC status, the uniform act will be designated as a "targeted act" by NCCUSL, which means that significant resources will be devoted to its enactment.
Supporters of the legislation say NCCUSL has a strong track record when it comes to promoting and enacting uniform legislation. Other widely adopted uniform laws include the Uniform Limited Partnership Act, the Uniform Trade Secrets Act, the Uniform Partnership Act and the Uniform Fraudulent Conveyances Act.
